Jailbirds: Does the magazine violate our civil rights?


This question is being presented. Does the practice of posting mugshots on the internet and magazines before a person has actually been convicted violate a person's civil rights? Research the ideas behind American Civil rights and laws that protect people and their privacy in the United States. Your answers should not be straight opinion. No, if you commit the crime others should be warned about the crimes you have done. no matter how big or small. Whether or not your convicted you was arrested and they take mugshots as soon as you get in jail. if they book you, they take your fingerprints, mugshot and other info.

Jailbirds is a great way to check out people in community to make sure your children are going to be fine when they go to a friends or even jus to hang out. Lately, bad things have been happening to many children they are getting abducted and murdered.

So you are saying that by publishing the photo of non convicted felons that less children are being abducted? What if you are arrested because your friend shoplifted at the mall. You were together so they arrested you also because you got a little belligerent with the arresting officer. Your mugshot is taken as you mentioned and put in the jailbird magazine. After reviewing the store tapes they find you were actually on the other side of the store when your friend stole the item so the charges are dropped. Sadly though your boss at Wendy's sees your picture and you are fired. Also your boyfriends mother sees your picture and tells him he can no longer see you. He is respectful of his parents wishes and breaks up with you. Actually he was not so thrilled seeing your picture in the Jailbirds so it was not much of a struggle. Since you were never convicted how does that make you feel?

You have a good point. never would have thought about that, but if your found not guilty they should take it off. but still, i guess if it's a REALLY bad crime then you should get on there, this is a really hard discussion, there are so many ways to to feel about this , but either way whether your boyfriend breaks up with you or you get fired , then its the law. It's their job. They have to do it. Like I said I agrree with what you say , you make very good points.

I agree with you, if your with a friend and they get busted for shop lifting or something and you get arrested then its wrong for your face to show up in JailBirds because its gonna hinder you from getting a job or you can get fired from your job that your working at now. In the United States Constitution, it states that all people, yes, ALL people are innocent until proven guilty. When a person commits a crime, or is thought to have committed it, then their photo is automatically posted on a website and published in a magizine. This clearly violates our rights as citizens of the US. However, I also believe it depends on the severity of the crime whether or not your picture will released to the public. That would have to be determined by those who convict the suspected felons. With this being said, I do believe it is right to post a picture of a criminal if he or she is proved guilty, but not if they are simply suspected of a crime, becuase it could lead to a number of negative outcomes. - Aaron Earley

To Mrs. Stripling, as you can see from my previous statement, I most definitely agree with your arguement about the people being at the scene of the crime. If someone is convicted for simply argueing with a cop or something as small as that, then it is totally unjustified for their picture to be placed in such a magizine. This can cause their life tospiral downward, leaving them in a difficult position.

I believe that if you are taken away in handcuffs, then you have done something wrong, but I also believe that if you haven't been proven guilty, then your picture should not be placed in jailbirds.

I most definitely think that a mugshot can violate a persons civil rights. What if you had nothing to do with the crime that was committed and you were just in the wrong place at the wrong time...? Now, the person who actually committed the crime, and your mugshot is posted in the Jailbird Magazine. Even though the charges are dropped against you. Your mugshot still remains in the magazine. You could lose your job if you have one at the time, and if not. It could possibly ruin your chances for any career that you might have in the future.

I don't believe that they should be able to post pictures of people mugshots before they were convicted, unless it was like a DUI or something like that, because they might not be quilty. If someone has a babysitter and their sitter was falsey accused it could ruin their life. And some people don't have all that money to remove their picture.

I agree with Monica and Bronson 100%. On average, 10,000 innocent people are convicted wrongly each year. I believe that after the person is found guilty of the charges that Jailbirds should be able to release the picture to the public to warn the citizens of the area.

With that in mind, I believe that the magazine Jailbirds does violate the civil rights of everyone whose picture was printed. The mugshots are those of everyone who were arrested, but NOT found guilty! For instance, the man in this article is just a suspect in this case. He is forever effected by this. He could have nothing at all to do with this murder and robbery, but he will always have his mugshot in Jailbirds and on the Jailbirds website. This doesn't just apply to this man, but to the many others that are exposed to the public through Jailbirds. Especially to the people who were found innocent or the charges were dropped. People should not post the it until that person has found guilty. Nowadays, internet spread things that most of it are not the truth even not exist. People just tend to follow the crowd keep posting issues without thinking. Sometimes, after someone has arrested although he hasn't found guilty, people post this thing and this may cause the "justice" inside of people that push them to dig out everything about the suspect. This kind of internet research will ruin not just the suspect's life but also the life of people around him. A lot of people especially young people suicided because of the pressure form the internet, maybe they have nothing to do with the crime. ---Christy

This argument works both ways in my opinion. A mug shot for certain people is to let the community know who they surround themselves with and what's going on. For instance if I have a neighbor who did something and went to jail I would like to know who. But also some mug shots are for somebody who did nothing just was in the wrong place and the wrong time , and I wouldn't like for everybody to see a mug shot of me for a misunderstand. I highly recommend you to get permission if its your first time getting a mug shot and if you want it up. The law states your not guilty until proven , well until your proven you did what they accuse you off then they should put it your mug shot. It has it advantages and disadvantages and go both ways and different views. -Ravyn

The argument is very clear. Mug shots are used to allow people to see those who have been victimized. I do believe that for a person to be victimized they must be proven guilty. These people having mug shots displayed have not been proven guilty. They should prove them guilty before anything else is done then publicly announce it. _ Hannah

Personally, I can't decide how I stand on this. I understand why some people want to see other people's mug shots. If I were an adult and had a family, I'd like to know if anyone that I associate with may one day hurt me or my family. On the other hand, not everyone in the mug shots were/are convicted. That means their lives were ruined because someone posted or shared their mug shot before hearing a verdict.-Kendal

I understand that people in the community would want to be aware of possible criminals, but just because they have a mug shot, doesn't mean that they did something. I believe that a person's mugshot should only be shown in Jailbirds or similar materials depending on if they have been convicted and what there charge is. For example if someone is caught with illegal substances then their mugshot should be shown but, if someone is arrested for something they didn't do then they should wait until that person is fully convicted through a trial with a jury of peers -Dj

Jail Birds should not be able to post innocent people mugshot before they even go to court or anything. The 4th Amendment states "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized". Also they should not be able to charge people to take their picture down if they are innocent because it goes against the 4th Amendment.

I think that it does violate civil rights. A person shouldn't be made into a criminal until after they are convicted. And by posting a picture of someone online, it is invading that persons life. But then again, if you are arrested then there is a reason you got arrested. If you weren't doing the wrong thing at the wrong time then you wouldn't have been in trouble.

I think it does violate a person's rights. I asked my uncle who is an officer about how he felt about the situation. He stated " people commit crimes all the time but sometimes people catch the wrong people. I think that the newspaper is a way to warn people of these criminals when they have been found guilty". So then i asked him if he thought it was reasonable for someone to have to pay 500$ to get their picture taking out of that paper. His response was " I think the innocent should be able to have their pictures removed for free". The people that get arrested did not give consent to have their picture uploaded or printed so why should they be blackmailed to pay

It does violate our civil rights. Civil rights violation refers to an offense that occurs as a result of the use of force or the threat of force by the offender against a victim. When a person's mugshot is posted it does violate their civil rights because most people such as Police Officers always have a preconceived bias of people many black people get shot or always thrown in jail just because of their race and they always seem to think that they are the only people who do anything wrong. We always see black people who are accused of doing wrong things but it is rarely ever that you see Cops who shoot white people because of their race

When someone is arrested and they have to get a mugshot taken it shouldn't be out in media until they are proven guilty because then people automatically judge them when they get out. People who get arrested should have the right to say no to having their mugshot taken. People who get arrested are innocent most of the time and it isn't fair when their picture is blasted all over social media.

Even criminal records like arrest information and public mugshots can be accessed and exploited online. Mugshot removal websites have built a business around displaying arrest records and demanding payment to delete the photos. However, victims now have many options to remove these damaging images from Google. no one shouldn't be posted untill they are found guilty

I do not think that jailbirds is a violation of people's rights because when someone is arrested that is public record even if they have not been convicted. On one hand you can argue what if later they are found to be innocent and their picture is put on a website for everyone to see, but you also have to think, what if they didn't? What if the spartanburg county officers arrested someone with nothing but mistaken identification ,which is the leading cause of wrongful convictions. Yes they have their one phone call but what happens when the person you call doesn't want to come get you out/ doesn't want to get involved. You end up sitting in jail without a hope of someone knowing your there. Then again, that's if they are convicted, what if you arent and you are there as an innocent party or there because you happened to be at the wrong place wrong time and get your mugshot taken and put on the website. If you were innocent they have ways of getting rid of the charge from your record.

Well its not right at all I mean you have really famous people that have a lot of money that if they are arrested they will put their mugshots no matter who you are they will put it up their. And you have to think if people don't know about your mugshot up their but one person does they can take advantage of that and blackmail you into giving your money on keeping quiet but if you don't care it won't matter just be honest at that point if you don't care.

If someone wants a job and are found innocent and their picture is already posted on the internet then they more than likely are not going to be able to get that job . In the state of south Carolina once you are arrested and booked in jail, you then have no say so in anything that happens to you,they can post any image of you to the internet and there is nothing you can do about it. Travis Harris

Although it is legal,I feel that it is wrong to post a mugshot of someone who hasn't been convicted mainly because you may or may not have actually committed the crime. In South Carolina, you have no say so in what happens with your mugshot. Mugshots can help find people when they have absconded, or warn people when someone is out and dangerous. So there is a good reason to share some mugshots. In the United States, arrest records are not released before a finding of guilt. I think its good that we have mugshot-Heather Belcher

I believe that putting someones mugshots up before they are convicted is wrong and can damage their reputation also limited their choices and opportunities in life.In florida the federal government is under no obligation to release mugshots of accused criminals under the Freedom of Information Act, even though many states and localities routinely make such booking photos public, a federal appeals court ruled Wednesday.

It's literally every race not a specific one, anyways I absolutely agree with the rest of you comment . Florida is famous for among other things most states and the federal government have laws that provide access to non-confidential document. But i don’t think its ok if they publish your mugshot before being guilty because what if they haven't done anything wrong but its already up there.

If someone was looking for a job and they look and search their name up if probably wouldn't get the job. But just because mugshots are a public record doesn't necessarily mean they get published. Mugshots are published in two ways: they are either published by the police department, or released to private entities upon request. And there are potential problems with either scenario, especially when it comes to publishing mugshots online.

I think in some cases mugshots can be a positive thing but they're also harmful. If the person has been convicted or not it can still harm them and destroy their lives. One example of this is Gregory Rakoczy, who was labeled as a felon on the run due to a mistake his firm made. He did what was necessary to fix the mistake and served 5 years probation, but 15 years later he's still labeled as a felon on the run. Because of this, he struggles to live his life and even says, "'I’m an old school New Yorker, so every time I am introduced to somebody I say my own name. Posting someone's mugshot its just not right because its violating there rights and if innocent people will still view you as guilty because they found your picture of you being convicted. It is wrong to to do this according to Debbie Jo Lashaway because theses websites for jailbirds are not news outlets and therefore not exempt to the publicity laws they are violating by making money off of these pictures. I most definitely think that a mugshot can violate a persons civil rights. Honestly if you were minding your own business and were just in the wrong place at the wrong time you get arrested. Now, the person who actually committed the crime, and your mugshot is posted in the Jailbird Magazine. Even though the charges are dropped against you, your mugshot will stay and always keep bias thoughts against you. You could lose your job if you have one at the time. i think that they shouldn't post mugshots of innocent people because it embarrasses people and colleges can see them. People will also think different of them when they see their mugshot posted. For example Tim masters when he was 15 years old he was walking to school and came across the dead body of Peggy hettrick. He did not tell anyone and people began suspecting that he killed her. He got out because a DNA test found a differant victum

House Bill 14-1407 requires commercial websites that charges a fee to remove people's mugshots or other identifying information to remove that information for free if the person was found innocent of the crime for which they were arrested. I do not think it is right to post innocent peoples mugshot because it can ruin their lives.

I personally dont think it's a good idea to have photos put up of you when your'e innocent because it can affect your jobs in the future and everybody's opinion on you. This shouldn't be a thing.

I beleive that someone posting ur mugshot before you are convicted ia a violation of our civil rights. Because it does effect you because once people see that mugshot even if u were innocent they will judge your every move. And just because of that one mugshot you might not even be able to get a job. If a mugshot of someone is posted to the public then it is setting out a certain image, that this person is a criminal and has done something illegal and they are most of the time looked down on because of that mugshot. Danielle Dirks, who works in the department of sociology at Occidental College in Los Angeles, says " In my interviews with over 60 individuals across the U.S. who have had their mug shots posted online by third party websites, I have found that the large majority has been devastated—personally, socially, fiscally—by this information being posted. In the short term, they are mortified by what they perceive as a major privacy violation, they are angry that individuals are capitalizing on their mistakes, and they live in fear that their loved ones or employers will happen upon the information." With this information, we can see that the mugshots negatively effect those people. Whether they've been charged or not. Danielle Dirks also states that "In the long term, many of the individuals I interviewed were effectively removed from the labor market or marginalized from their jobs and careers, given the sheer number of employers who routinely scour the Internet when hiring." Sheena Foley from South Burlington, Vt. was stunned after she got a traffic violation because she had rolled through a stop sign while driving without a current license, she said, led not just to an arrest but to public embarrassment as well. The police department led to then posting her booking photograph on their Facebook page. Foley stated, “I actually felt like I was a murderer or selling drugs or something. Are they doing this because they think if they put your picture up you won’t do it again?” It is very embarrassing and humiliating for people to have their picture posted for something that they didn't do or a crime that was not serious that could ruin their chance in getting a job or a chance of ruining their reputation.

I think Mug shots aren't that bad as some people look at it as "just a picture" but others see it as a criminal in the making or just a bad person. If a person was found guilty and their mug shot still got out, it can destroy your reputation and mostly your career. One example is R Kelly who was and still is considered one of the best R&B singers of all time but is now facing loss of reputation, music career and personal relationship problems because of a case that was brought back up 10 years later. In July, R. Kelly's alleged sexual misdeeds returned to the headlines, after a Buzzfeed News story claimed R. Kelly lures women into "cult"-like sexual relationships. The singer "unequivocally denied" the allegations via his lawyer Linda Mensch. Jerhonda Pace, who had history with who claimed she was sexually involved with the R&B superstar when she was 16. According to sources, there was a video of R Kelly allegedly peeing on a 15 year old girl in his studio and not only did the court see it, it also got leaked. After this case, R Kelly was suprisingly proven innocent from over 5 counts of sexual abuse.

Mugshots should not be posted unless the person is found guilty. Even then i believe there should be some sort of scale to determine if the mugshot is posted based on the severity of the crime. It isn't the business of the public if it does not put them in danger. For example, if someone goes to jail for a warrant issued because of past due child support or failure to appear in court, I don't think their mugshot should be posted because that isn't something that concerns the public. However if someone goes to jail for murder, the public has every right to know AFTER the person is found guilty.

I believe that posting someones mugshot is what should be done after someone gets arrested. The people need to be informed on what i going on around them. I don't think that it is right to depry the public the information that they have the right to know. For decades it has always been this way and changing the rules bow wouldn't be fair to anyone. Yes, it may hurt the person in the future. Weather it be a future job or a house hunt or anything that is important where your past life is involved. But, in my opinion if that person didn't put themselves in that situation to begin with then they wouldn't have to worry about those situations such as those scenarios and worry about what people are gonna think about them. According to Chris Corollas article "journalists and some libertarians are opposed to such measures, calling them an infringement on the publics right to know what the government is doing." This is basically saying that if you believe that public mugshots are invading your privacy and that it is wrong you are also saying that it is okay to take away are right to know what the government is doing. You are saying one thing is right and the other is wrong and that is not how things work in the real world. It is healthy to know what we need to be looking out for. The world is a dangerous.Mugshots being public is a great thing. A thing no one should want to get rid of.

In my opinion i think they shouldn't be posting mugshot's when the person get's arrested why well what if they get arrested and they put up they mugshot and later on that day that person was found innocent well they just posted the mugshot and now everyone is gonna see it and it's going to make the person look bad even though they were found non guilty now if they know the person did it then it's okay to post it i think it's better to find more evidence and then if there guilty they should post it.

Mugshots are posted in newspapers, online, and in many more places. The post of someones mugshot should not be allowed, until they are proven guilty. Lets say you are accused of stealing something, and you never did. Then you get arrested and all of your friends and family see it, wouldn't you feel bad ? Mugshots should not be posted until it is proven that you have committed a crime, or they shouldn't be posted at all.
